By accessing or using the services of Gateway Nanny Agency (“we,” “our,” or “us”), you agree to be bound by these Terms & Conditions. Please read them carefully.
1. Nature of Services
Gateway Nanny Agency is a referral and placement agency. We connect families seeking childcare with qualified nanny candidates.
We do not employ nannies directly.
Families are the direct employers of any nanny they hire.
We do not manage payroll, taxes, or employment benefits for nannies.
2. Candidate Information & Background Checks
Candidates may provide personal and professional references and employment history.
We may conduct background and reference checks through third-party providers.
While we strive for accuracy, we do not guarantee the completeness or accuracy of third-party reports.
Families and candidates acknowledge that hiring decisions are their responsibility.
3. Information Sharing
Candidate and family information is shared solely to facilitate placements.
This may include limited identifying details such as first names, general location, and position details.
All parties agree not to misuse or disclose information outside the agency process.
4. Placement Fees & Payments
Gateway Nanny Agency charges placement fees for matching families with candidates.
Fees are non-refundable, unless otherwise agreed in writing.
Placement fees apply regardless of whether the nanny was first introduced by Gateway Nanny Agency or subsequently contacted directly.
5. Non-Circumvention
Families and candidates agree not to bypass Gateway Nanny Agency to arrange employment or placement directly without paying applicable fees.
This clause protects the agency’s right to collect placement fees for successful matches, even if the introduction leads to direct employment later.
6. User Responsibilities
By using our services, you agree to:
Provide accurate, truthful information about yourself or your family.
Use information provided by Gateway Nanny Agency only for its intended purpose.
Communicate and interact in a professional and respectful manner.
7. Confidentiality of Candidate Profiles
The Client acknowledges that certain Candidate information, including references, allergies, and vaccination status, may be shared by the Agency for placement purposes and that this information is strictly confidential and intended solely for hiring decisions.
8. Limitation of Liability
Gateway Nanny Agency is not liable for the actions, behavior, or performance of any nanny or family.
We are not responsible for employment disputes, injuries, or damages arising from placements.
Our total liability is limited to the amount of placement fees paid, to the maximum extent permitted by law.
9. Governing Law
These Terms & Conditions are governed by the laws of the State of Missouri. For disputes not subject to another state’s mandatory law, parties agree that Missouri law will apply. Any disputes that cannot be resolved amicably will be addressed in courts located in Missouri.
10. Changes to Terms
We may update these terms at any time. Changes will be posted on our website, and continued use of our services indicates acceptance of the updated terms.
